Welcome to DuplicateMe.io ("Service"), an AI-powered content generation platform operated by an individual sole proprietor ("we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

DuplicateMe.io is a software-as-a-service (SaaS) platform that provides AI-powered content generation. Users can upload audio samples and generate AI-produced content based on those samples. The Service is provided on a subscription basis with tiered plans offering different capabilities and usage limits.

To use the Service, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction.
• Provide a valid email address for account registration.
• Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
• Provide accurate and complete information when creating your account.

You must not share your account with others or allow unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the Service to:

• Generate content that impersonates real individuals without their explicit consent.
• Create misleading, fraudulent, or deceptive content intended to harm others.
• Produce content that is illegal, defamatory, threatening, or violates the rights of any third party.
• Distribute spam, malware, or any harmful material through the Service.
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
• Circumvent usage limits, rate limits, or any technical restrictions of the Service.
• Resell access to the Service without prior written agreement.

We reserve the right to remove content and suspend accounts that violate this acceptable use policy, at our sole discretion and without prior notice.

The Service offers both free and paid subscription plans. Paid plans are billed monthly through our payment processor, Stripe.

• Billing cycle: Subscriptions are billed on a recurring monthly basis starting from the date of purchase.
• Payment methods: We accept payment methods supported by Stripe, including major credit and debit cards.
• Price changes: We may adjust pricing with 30 days' notice to existing subscribers. Your continued use after the price change takes effect constitutes acceptance.
• Failed payments: If a payment fails, we may downgrade your account to the free tier until payment is resolved.

All prices are displayed in euros (EUR) and are inclusive of applicable taxes unless stated otherwise.

No refunds on used generations. Because AI content generation consumes computational resources at the time of use, we cannot offer refunds for generations that have already been processed.

If you have not used any generations during the current billing period, you may request a refund within 7 days of your billing date by contacting support@duplicateme.io. Refund requests are evaluated on a case-by-case basis.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until then.

Your content: You retain full ownership of all content you generate using the Service. We do not claim any intellectual property rights over your generated content. You are free to use, distribute, and commercialize your generated content without restriction.

Your uploads: By uploading audio or other materials to the Service, you represent that you have the necessary rights to use that material and grant us a limited license to process it for the purpose of providing the Service.

Our platform: The DuplicateMe.io platform, including its design, code, AI models, branding, and documentation, is our intellectual property. You may not copy, modify, or redistribute any part of the platform without written permission.

If API access is made available as part of your plan, the following terms apply:

• API usage is subject to rate limits as defined by your subscription tier.
• API keys are personal and must not be shared or published publicly.
• We reserve the right to revoke API access if usage patterns indicate abuse, excessive load, or violation of these Terms.
• We may modify the API interface with reasonable notice. We will make best efforts to maintain backward compatibility.

You may close your account at any time by contacting support@duplicateme.io. Upon closure, your data will be deleted within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your account immediately, without prior notice, if:

• You breach any provision of these Terms.
• Your use of the Service poses a security risk or legal liability.
• Your account has been inactive for more than 12 months.
• We are required to do so by law.

Upon termination, your right to use the Service ceases immediately. We are not liable for any loss of data resulting from account termination.

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not responsible for the quality, accuracy, or appropriateness of AI-generated content. You are solely responsible for reviewing and using generated content.

These Terms are governed by and construed in accordance with the laws of Ireland and applicable European Union regulations, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ireland. For EU consumers, this does not affect your rights under mandatory consumer protection laws of your country of residence.
